What is a Sworn Translation?

A sworn translation is a translation that comes with a certification from the translator confirming its accuracy. Accreditation for translators can vary by jurisdiction. It is crucial to understand that what qualifies as a sworn translation can differ from one place to another, depending mainly on whether the translator is recognized as a sworn translator in the relevant area.

As a company based in Spain, we follow the regulations for sworn translations specific to the Spanish context. In Spain, sworn translations must be identified as the work of a sworn translator. This is done by including the translator’s stamp and signature on the document. Sworn translators in Spain are appointed by the Spanish Ministry of Foreign Affairs and must either pass an exam or have a university degree in translation to qualify. Thus, sworn translations in Spain are regulated by the state.

In many English-speaking countries, the organizations that authorize sworn translators are usually independent entities formed by members of the professional translation community. Examples include the Institute of Translation and Interpreting in the UK, the Irish Translators and Interpreters Association in Ireland, and the American Translators Association in the US. A notable exception is Australia, where the national body, the National Accreditation Authority for Translators and Interpreters, is a state-owned entity. Although the lack of state regulation might be concerning, these associations set and enforce their own standards. However, from a Spanish perspective, the regulation and accreditation process for sworn translators is quite distinct.

When is a Sworn Translation Required?

A sworn translation is likely needed for an official procedure. It benefits the official body receiving the documents by expediting the process and ensuring that the recipient can clearly understand the original document without extra time or cost. The sworn translator, appointed by the Spanish Ministry of Foreign Affairs, certifies the translation, making it readily accepted. If the translator is not appointed by this Ministry, the translation must be reviewed by a Spanish diplomatic mission or consulate, or by a diplomatic mission or consulate in Spain from the country where the document originated.

How to Verify if a Translator is Sworn

In Spain, all sworn translations have a stamp indicating the translator’s full name, the languages they can translate, and their sworn translator number. The translator also signs the translation, which includes a declaration in both Spanish and the target language, certifying their appointment, understanding of the text, and that the translation is accurate. If you have any doubts about the translator’s official status, you can check the official list of translators maintained by the Ministry of Foreign Affairs. This list is organized by language and by the province or country where the translator resides. It includes the appointment date and whether the translator qualified through a university degree or by passing the state exam. Each section lists translators alphabetically for easy reference and includes contact details and their current status («active» or «inactive»).
